Suncor Letter to AER re: AWA Reply Submissions for the Reconsideration of MLWC Operational Plan Approval

On June 16, 2023, AWA received copy of a letter sent by Suncor Energy to the Alberta Energy Regulator (AER) regarding AWA’s reply submissions, submitted to the AER on June 9, as part of the reconsideration process for the AER’s approval of Suncor’s McClelland Lake Wetland Complex Operational Plan.

According to the letter AWA received from the AER dated April 18, 2023, the final submission deadline as part of this Reconsideration Process was Friday, June 9, 2023 by 4:00 PM.

Although Suncor’s latest letter was submitted beyond the June 9 deadline, Suncor requests that the AER disregard AWA’s June 9 reply submissions, on the grounds that AWA’s reply “introduces a significant amount of new information not previously introduced or referred to in this proceeding.”

Both of AWA’s submissions (May 8, June 9) to the AER present new information and assert that the new information could lead the Regulator to a different conclusion upon reconsideration, namely that the Operational Plan does not guarantee protection of the unmined portion of the MLWC, and therefore does not satisfy the conditions of the Water Act Approvals and 2002 EUB Decision.
