AER Decision Letter Re: CNUL Jackpine Mine Renewal Application Joint Statement of Concern

On Monday, March 10, 2025, the Alberta Energy Regulator (AER) notified Ecojustice, Alberta Wilderness Association, and Keepers of the Water of its decision regarding the joint Statement of Concern submitted to the AER on Thursday, March 7, 2024, about an integrated renewal application for Canadian Natural Upgrading Limited’s (CNUL) Jackpine oil sands mine. Our Statement of Concern also requested that the AER recognize the Athabasca River Basin as a directly and adversely affected person.
In its decision, the AER determined that a hearing would not be required, and the AER also declined to decide on the issue of whether the Athabasca River could serve as a directly/adversely affected party. Many of the concerns included in the submission, including the lack of monitoring data, were considered “out of scope” in the AER’s decision.
